VEHICLE REGISTRATION

 Where do I need to go to register a car and what documents to provide? Is it required to inspect the car and check it for search and theft? How much will this procedure cost?

WHAT VEHICLES NEED TO BE REGISTERED?

The following types of motor vehicles and trailers are subject to state registration:

  • cars, trucks, buses, including special vehicles made on their basis, and trolleybuses;
  • motorcycles, tricycles, quad bikes and mopeds with a maximum design speed of more than fifty kilometers per hour;
  • trailers designed to move in combination with cars.

(paragraph 1 of Article 64 of the Law of the Republic of Kazakhstan "On Road Traffic").

WHAT VEHICLES ARE NOT SUBJECT TO STATE REGISTRATION?

The following are not subject to state registration:

  • combat vehicles, tractors, including self-propelled chassis and mechanisms made on their basis, trailers used as off-road technological transport;
  • trams and other rail vehicles;
  • cars, trucks and buses, including special cars made on their chassis, motorcycles and motor scooters, trailers intended for movement with cars, registered in other states and imported into the territory of the Republic of Kazakhstan for a period of less than one year.

(paragraph 3 of Article 64 of the Law "On Road Traffic").

DOES REGISTRATION PROVE OWNERSHIP?

According to subparagraph 1 of Article 62 of the Law "On Road Traffic", state registration of vehicles is a form of registration of vehicles for participation in road traffic and (or) operation on the territory of the Republic of Kazakhstan and abroad. Ownership of a vehicle arises at the time of conclusion of a transaction for its acquisition or at another moment specified in the transaction. Vehicle registration is not a registration of ownership. A vehicle is a device designed to transport people, goods or equipment installed on it by road (subparagraph 28) of Article 1 of the said Law). The vehicle has this status, and not being registered, however, its legal operation in this case is impossible.

WHO IS THE VEHICLE REGISTERED FOR?

The vehicle is registered:

  • for individuals who are the owner, at their permanent place of residence or at the place of temporary residence for the period of temporary residence.
  • for legal entities that are their owners, at their location;
  • for branches and representative offices of legal entities - at the location of branches.

(Clause 5 of the Rules for State Registration and Accounting of Certain Types of Vehicles by Vehicle Identification Number).

WHERE IS REGISTRATION MADE?

The registration procedure is:

  • in the registration and examination divisions of the internal affairs bodies (REP);
  • in special service centers for car owners ("special PSCs").

VEHICLE INSPECTION

When registering, the owners provide a vehicle for inspection at the registration point or on the territory of the Special PSC to check:

  • the safety of the design of the registered vehicle;
  • authenticity of number units and license plates (identification of hidden, forged or otherwise modified number units, as well as number plates) and their compliance with the data specified in the documents for vehicles and / or in the information system of the police authorities.

The results of the inspection are noted in the vehicle registration ac . The results of the inspection are valid for 20 calendar days (paragraph 12 of the Rules).

DISCREPANCY BETWEEN UNIT NUMBERS AND DOCUMENTS

If during the inspection of the vehicle discrepancies in the numbering of units and assemblies with registration documents are revealed, the owner, in accordance with paragraph 47 of the Rules for State Registration and Accounting for Certain Types of Vehicles by the identification number of the vehicle, must apply to the internal affairs body for a conclusion on the possibility of setting on account. Such a conclusion is issued after checking the circumstances of the number change (repair, loss of a plate, etc.) in the absence of the vehicles being wanted and grounds for initiating a criminal case.

WANTED CHECK

When registering a vehicle, it is checked against the information resources of the internal affairs bodies in order to find them on the wanted list. The result of the inspection is noted in  the vehicle registration certificat indicating the date, time, name and signature of the authorized officer who conducted the inspection.

GOVERNMENT DUTY

The following mandatory payments (state duty) are established for the registration of vehicles in accordance with subparagraph 9) of Article 540 of the Tax Code of the Republic of Kazakhstan:

  • for the issuance of a certificate of state registration - 125% of the monthly calculation index (MCI);
  • for the issuance of a state license plate for a car - 280% of the MCI, for a motorcycle or trailer to a car - 140% of the MCI;
  • for state registration of a vehicle - 25% of the MCI.

LIST OF DOCUMENTS FOR REGISTRATION IN THE REP

For registration by vehicle owners, the following documents are submitted to the registration department (paragraph 17 of these Rules):

  • act of vehicle registration in the prescribed for ;
  • identity document (identity card of a citizen of the Republic of Kazakhstan, passport of a citizen of the Republic of Kazakhstan, birth certificate (for minors);
  • address reference;
  • documents confirming the payment of the state fee;
  • documents confirming the payment of vehicle tax or the right to tax exemption;
  • for legal entities: a certificate confirming the state registration (re-registration) of a legal entity, a branch, (representative office) of a legal entity, a charter (for verification) and copies thereof;
  • technical document (transport registration certificate (SRTS), vehicle passport (PTS));
  • certificate of the manufacturer or enterprise that installed special (or specialized) equipment on a vehicle within the Republic of Kazakhstan, or relevant customs documents for imported equipment, a certificate of conformity;
  • vehicle for inspection;
  • for legal entities: an order (instruction) on the allocation and transfer of a vehicle to its structural unit or to another legal entity or individual, certified by a seal;
  • a document confirming the ownership of the vehicle, which include:
    • documents confirming the passage of customs clearance (customs declaration, customs receipt order, obligation to re-export in cases of temporary import);
    • writ of execution with a court-certified copy of the court decision, resolution, notification of the bailiff on the actions of the state body subject to execution;
    • contracts of sale, donation. exchanges, certificates of the right to inheritance;
  • license plates "Transit".

LIST OF DOCUMENTS FOR REGISTRATION IN THE SPECIAL PSC

For registration by vehicle owners, the following documents are submitted to the registration department (paragraph 17 of these Rules):

  • identity document (identity card of a citizen of the Republic of Kazakhstan, passport of a citizen of the Republic of Kazakhstan, birth certificate (for minors);
  • documents confirming the payment of the state fee;
  • technical document (transport registration certificate (SRTS), vehicle passport (PTS));
  • certificate of the manufacturer or enterprise that installed special (or specialized) equipment on a vehicle within the Republic of Kazakhstan, or relevant customs documents for imported equipment, a certificate of conformity;
  • vehicle for inspection;
  • an order (instruction) of a legal entity on the allocation and transfer of a vehicle to its structural unit or to another legal entity or individual, certified by a seal;
  • a document confirming the ownership of the vehicle, which include:
    • documents confirming the passage of customs clearance (customs declaration, customs receipt order, obligation to re-export in cases of temporary import);
    • writ of execution with a court-certified copy of the court decision, resolution, notification of the bailiff on the actions of the state body subject to execution;
    • contracts of sale, donation. exchanges, certificates of the right to inheritance;
  • license plates "Transit".

DEADLINE FOR REGISTRATION

The vehicle must be registered:

  • when applying to the REP - no more than 6 hours from the date of submission of the necessary documents;
  • when applying to the PSC - no more than 2 hours.

(paragraph 4 of the Public Service Standard " Registration, re-registration of motor vehicles and the issuance of registration plates, with the exception of vehicles registered by the Ministry of Agricultur ").

WHO CAN APPLY FOR REGISTRATION?

A vehicle can be registered by the owner specified in the sales contract or other document confirming ownership, or his representative by proxy.

IS IT POSSIBLE TO DRIVE A CAR THAT IS NOT REGISTERED WITH THE TRAFFIC POLICE?

A vehicle that is not registered with the traffic police can only be driven if there are "Transit" license plates and only to go to the REP in order to present it for inspection before the registration of the vehicle, as well as when following to eliminate malfunctions identified during the inspection of the vehicle funds - if there are marks of officials of the authorized body corresponding to the vehicle registration certificate (paragraph 27 of the Rules). Validity of transit signs - 10 calendar days. It is extended by a traffic police officer once for 10 calendar days.

WHAT IS ISSUED AS A RESULT OF REGISTRATION?

As a result of vehicle registration, the owner receives:

  • certificate of state registration of the vehicle
  • state license plates.

IS THE REGISTRATION POINT OBLIGED TO RETURN THE ORIGINAL DOCUMENT CONFIRMING THE OWNERSHIP OF THE CAR?

After registration, the registration point does not issue back the documents provided by the owner on the basis of which the car was purchased (for example, a contract of sale). In doing so, he is guided by the fact that:

  • paragraph 30 of the above Rules, which states that the statements of the owners, documents confirming the ownership of vehicles (numbered units), released registration documents, license plates of the states of registration of vehicles (if they are not seized by the customs authority) imported into the Republic of Kazakhstan, and license plates "Transit" are handed over to the registration point (original documents are meant);
  • the specified Rules and other normative acts do not specify the obligation to return title documents.

This circumstance should be taken into account and, if necessary, stock up on another copy of the sales contract or its notarized copy.
