 How is the removal from the consular register of Kazakh citizens abroad? Where and with what documents do you need to apply? Should there be a seal imprint on the certificate of withdrawal from the list of the consulate?

In accordance with subparagraph 1 of paragraph 1 of the Instruction on registration of citizens of the Republic of Kazakhstan abroad, consular offices of the Republic of Kazakhstan abroad register the following categories of citizens of the Republic of Kazakhstan:

  • permanently residing in the territory of the consular district;
  • temporarily staying on the territory of the consular district (arriving on a business trip, for study, internship, contract work, treatment or private business). permanently residing in the territory of the consular district.

IN WHAT CASES IS IT NECESSARY TO DEREGISTER FROM THE CONSULAR REGISTER?

Deregistration is necessary when a citizen of the Republic of Kazakhstan returns from abroad to a permanent place of residence in the Republic of Kazakhstan or changes his place of residence abroad, leaving the consular district.

WHAT DOCUMENTS ARE REQUIRED FOR DEREGISTRATION?

To deregister from the consular register, a citizen must provide a passport to make a mark on deregistration.

HOW IS DEREGISTRATION CARRIED OUT?

DEREGISTRATION OF CITIZENS OF THE REPUBLIC OF KAZAKHSTAN PERMANENTLY RESIDING ABROAD

According to paragraph 16 of the Instructions for registering citizens of the Republic of Kazakhstan abroad, approved by the Order of the Minister of Foreign Affairs of the Republic of Kazakhstan dated October 18, 2000 No. 221, an entry is made in the registration card upon deregistration. A note is made in the passport: "Removed from the register ... (name of the consular office of the Republic of Kazakhstan and its location) in connection with ... (the reason is indicated)", date and signature of the person making the entry.

DEREGISTRATION OF CITIZENS TEMPORARILY STAYING ON THE TERRITORY OF THE CONSULAR DISTRICT

According to paragraph 22 of the Instructions for registering citizens of the Republic of Kazakhstan abroad, upon deregistration, a mark on deregistration is put on the registration card.

DEREGISTRATION OF CITIZENS WHO RETURNED TO THE REPUBLIC OF KAZAKHSTAN FOR PERMANENT RESIDENCE WITHOUT A MARK IN THE PASSPORT

If a citizen of the Republic of Kazakhstan arrived at a permanent place of residence in the Republic of Kazakhstan without deregistration in the country of residence, he must apply to the Department of Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan with an application for deregistration with a copy of the passport of a citizen of the Republic of Kazakhstan.

DO I NEED TO PAY A FEE FOR DEREGISTRATION?

According to paragraph 14 of the Decree of the Government of the Republic of Kazakhstan dated February 19, 2009 No. 197 "On approval of the basic minimum and maximum rates of consular fees, as well as the rate of consular fees for urgency", deregistration of citizens of the Republic of Kazakhstan from the consular register is free of charge.

THE PRESENCE OF A SEAL ON THE CERTIFICATE OF WITHDRAWAL FROM THE LIST OF THE CONSULATE

In accordance with paragraph 48 of the Model Rules for Documenting and Managing Documentation in State and Non-Governmental Organizations, approved by Decree of the Government of the Republic of Kazakhstan dated December 21, 2011 No. 1570, a description and confirmation of certain facts or events is drawn up with a certificate. The details of the certificate, in addition to the image of the State Emblem of the Republic of Kazakhstan, are the signature of the official, the seal (if necessary).

According to clause 5.21 of the State Standard of the Committee for Standardization, Metrology and Certification of the Ministry of Economy and Trade of the Republic of Kazakhstan ST RK 1042-2001 "Organizational and administrative documentation: Requirements for paperwork", documents executed on forms with the image of the State Emblem of the Republic of Kazakhstan are not certified with a seal, with the exception of financial documents, documents confirming the rights of citizens, and documents requiring special legal confirmation.

In addition, Appendix D to the said Standard provides for a list of organizational and administrative documents certified by a seal, which include certificates of a social and legal nature confirming constitutional rights, biographical facts of citizens.

Therefore, the certificate of withdrawal from the list of the consulate must be certified by a seal.
