In accordance with Article 101 of the Land Code of the Republic of Kazakhstan, land plots for running a peasant or farm enterprise are provided to citizens of the Republic of Kazakhstan on the basis of the right of private ownership or the right of temporary paid land use for up to 49 years. These plots are provided from the composition of agricultural land.

Individual housing construction, in accordance with Article 107 of the Land Code, is carried out on the lands of settlements, which include residential development lands.

In accordance with Article 49-1 of the Land Code, a change in the designated purpose of a land plot is carried out by local executive bodies (in your case, the district akimat). For this, it is necessary to apply with a written application addressed to the akim. The decision to change the purpose of the land plot is made on the basis of the conclusion of the land commission.

At the same time, it should be taken into account that the Land Code establishes the principles of land zoning, targeted use of land, and priority of agricultural land. Such a decision may be accompanied by the inclusion of a land plot within the boundaries of a settlement. The adoption of such a decision provides for the introduction of changes in land zoning projects (schemes), regional programs for the rational use of land, projects for the land management of rural settlements, and also involves an analysis of the effectiveness of agricultural land use.

Taking into account the numerous violations revealed recently in the Republic when changing the designated purpose of agricultural land, the solution of the issue will not be easy and is possible only after a comprehensive analysis of your application.
