DOES INSURANCE PAY OUT IF THE ACCIDENT WAS COMMITTED WHILE INTOXICATED?

 Will an insurance organization pay an insurance payment if the driver was in a state of intoxication at the time of the accident?

In this case, the insurance payment must be made. The norms of the Law of the Republic of Kazakhstan "On Compulsory Insurance of Civil Liability of Vehicle Owners" do not provide grounds for the release of the insurer from the insurance payment due to the presence of the perpetrator of the accident in a state of intoxication. This Law states that in the event of a driver’s civil liability as a result of driving a vehicle in a state of alcoholic, narcotic or substance abuse, the insurance company that made the payment transfers the right to claim back (recourse) from the culprit within the amount paid (subparagraph 1) paragraph 1 of article 28). However, the injured party should not be concerned.
