Under certain conditions, the justice authority may refuse to accept real estate documents for registration.
The list of these grounds is enshrined in Article 25 of the Law of the Republic of Kazakhstan "On state registration of rights to real estate and transactions with it."
Refusal to accept documents submitted for state registration is allowed on the following grounds:
- appeal by an improper person or due to the lack of documents proving the identity of the applicant or his authorized representative;
- the presence in the documents of erasures, additions, crossed out words and other unspecified corrections;
- incorrect filling of application forms submitted for registration;
- submission by the applicant of an incomplete package of documents required for state registration;
- submission of documents, the form and content of which do not comply with the legislation of the Republic of Kazakhstan.
Refusal to accept documents for registration may be appealed to a higher body of justice or to a court.
When the grounds for refusal to accept documents are eliminated, documents for registration are submitted again in the general manner.
