The legislation of the Republic of Kazakhstan in the field of military service and the status of military personnel provides for the possibility of exemption from service. The list of grounds for exemption from conscription for military service is established by law.
GROUNDS FOR EXEMPTING CITIZENS FROM CONSCRIPTION FOR MILITARY SERVICE
In accordance with Article 36 of the Law of the Republic of Kazakhstan "On military service and the status of military personnel" citizens are exempted from conscription for military service by conscription in peacetime:
- Recognized as unfit for military service for health reasons;
- Those who are not legally called up for compulsory military service upon reaching twenty-seven years of age;
- One of whose relatives (father, mother, brother or sister) died, died or became disabled of the first or second group in the line of duty during military service;
- Passed military (alternative) service in another state;
- Having a degree;
- Priests of registered religious associations.
THE FOLLOWING ARE EXEMPT FROM CONSCRIPTION FOR MILITARY TRAINING:
- Persons working in state bodies of the Republic of Kazakhstan in positions related to ensuring defense, security and law and order;
- Aviation personnel of state, civil and experimental aviation;
- Persons working in agriculture and in organizations for the repair of agricultural machinery, for the period of sowing and harvesting;
- Pedagogical employees of educational organizations of full-time education for the period of the academic year;
- Students in educational institutions of full-time education;
- Persons liable for military service - women;
- persons liable for military service within two years after being transferred to the reserve;
- Persons with three or more children under the age of eighteen;
- Persons in respect of whom an inquiry is being conducted, a preliminary investigation or a criminal case is being considered by a court;
- Persons liable for military service, elected deputies of the Parliament of the Republic of Kazakhstan or local representative bodies.
According to paragraph 6 of article 36 of the Law "On military service and the status of military personnel", citizens with a criminal record are not subject to conscription for military service in peacetime.
All citizens exempted from conscription for fixed-term military service are issued military tickets, and they are transferred to the military registration of those liable for military service.
